Professor Emerita Nicola Peart ONZM has written a substantial 795-page book about the Trusts Act 2019 and its intended effect – an up-to-date work on contemporary aspects of trust law in New Zealand, including tikanga.
While the Act focuses on express trusts, Introduction to the Trusts Act also deals with trust topics that sit outside the legislation, such as settlor-controlled trusts, constructive trusts, resulting trusts and remedies for breach of trust. This gives readers a relatively comprehensive account of most topical trust subjects, whether they are dealt with by the Act or not.
Much of our current law concerning trusts is scattered among legal articles, seminar papers and poorly reported judicial decisions. In Peart’s book, these materials are collated logically and comprehensively, meaning practitioners no longer need to engage in extensive research on many aspects of trust law.
Peart is well-placed to write this book. The 2019 Act originated from extensive preparatory work by the Law Commission. She was closely involved with the legislation from its inception through to its enactment, as a member of both the Law Commission’s Expert Advisory Group and, subsequently, the Ministerial Advisory Group on the Trusts Bill.
The book is a practical and helpful text which will become an indispensable resource for anyone with a serious interest in the law of trusts in New Zealand.
