In a previous article, The Googling Juror – The Fate of the Jury Trial in the Digital Paradigm, I explored the way the internet has complicated the operation of the criminal jury trial.
The web had transformed how people obtain, share and interact with information. As a result, shielding jurors from extraneous material is increasingly difficult. With smartphones and laptops, a juror could instantly consult Google Earth, revisit crime scenes or seek out prejudicial coverage about an accused. The temptation for a juror to become self-informing remains.
